Business Immigration under Investor's Category

Canada allows successful business owners and managers to immigrate by investing $400,000 CDN for 5 years, interest free, into a Government guaranteed Immigration Fund. Unlike the Entrepreneur program, investors and their family members are given unconditional immigrant visas, and are free to live anywhere in Canada.

Business Immigration under Entrepreneur's Category

An entrepreneur is an immigrant who is willing and able to invest in, and manage, a business which will benefit Canada's economy and employ Canadians or permanent residents. We have helped entrepreneurs present their cases to Visa Officers. After they arrive, we have used our business law resources and local business contacts to help them purchase, invest in, or set up businesses to fulfill their immigration conditions.


Entrepreneur Condition Removal

In the first 3 years after entrepreneurs land in Canada, they must own and manage a Qualifying Canadian Business. If they do not remove their terms and conditions within 3 years after landing in Canada, entrepreneurs and their family members could lose their Permanent Resident status.

At Hwang & Company, through our extensive experiences in business law and local business contacts, we have helped our clients buy, invest in, or set up many different kinds of businesses so that they can secure their Permanent Resident status.


Provincial Nominee Program

Many Canadian provinces have programs to "fast track" people who will contribute to their economic development; these are called "Provincial Nominee Programs". Some people who would not qualify under the normal Immigration rules may qualify as Provincial Nominees. Others, who could qualify under the normal Immigration rules, may still want to apply as Provincial Nominees because of the faster processing times. British Columbia has a Provincial Nominee Program, and can nominate up to 1,000 applicants for expedited immigration processing.


Intra-Corporate Transferee

Canada's immigration laws have specific provisions for Intra-Corporate Transferees. These provisions allow executives, managers, and those with specialized knowledge in multinational firms to travel and work freely.

We have successfully assisted numerous Korean companies to set up their branches in Canada and apply for work permits under the Intra-Corporate Transferee provisions to operate their businesses in Canada.


Work Permits

In order to work in Canada as a foreigner, a work permit is required unless:

a) the activity is not considered "work" under the Immigration Refugee Protection Act; or

b) the activity is exempt from the requirement for a Work Permit.

A work permit is issued by Citizenship & Immigration Canada. While most work permits require approval by Human Resources and Skills Development Canada ("HRSDC" Validation), some can be issued without HRSDC Validation. Our office can provide you with more details.
